3.5. Trade Agreements

Users shall comply with all applicable import, re-import, sanctions, anti-boycott, export and re-export control laws and regulations, including all such laws and regulations applicable to EU and US companies, such as Export Administration Regulations, International Traffic in Arms Regulations, Foreign Assets Economic sanctions programs implemented by the Office of Control and the European Union's Common Foreign and Security Policy (collectively, the "Trade Sanctions Act"). User represents and warrants that User and User's financial institution, or any party that owns or controls User or User's financial institution, is not sanctioned or otherwise designated on any list of prohibited or restricted parties, including but not limited to the United Nations Security Council, the United States Government-maintained lists (for example, the U.S. Treasury Department's Specially Designated Nationals List and Foreign Fugitive List, and the U.S. Department of Commerce's Entity List), the European Union or its member states, or other applicable government agencies.
