9.Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AIRship AND USER SHALL NOT BE LIABLE FOR LOST REVENUE, OPPORTUNITY COST OR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES UNDER THESE TERMS AND CONDITIONS, EVEN IF Airship knew or should have known Such damage is possible even if the immediate damage does not satisfy the remedy. This limitation of liability does not apply to violations of Airship’s intellectual property rights, indemnification obligations, or the user’s payment obligations.
